1. About these terms
These Terms and Conditions apply to the Scaling It website at www.scalingit.au, the app at app.scalingit.au, the public Starter Quiz, account plans, standalone Solution Options purchases, and related online content and support. By creating an account, buying a service or using the app, you agree to these Terms. Website visitors must also comply with the provisions relevant to public website use.
Scaling It is operated by Scaling It, ABN 49 616 366 294, in Australia. If you do not agree with these Terms, please do not create an account, buy a service or use the app.
2. What Scaling It provides
Scaling It helps small businesses understand their systems, consider practical options for improvement, plan and guide changes, evaluate outcomes, and manage their knowledge and records over time. Available features depend on the service or plan you use and may include assessments, Snapshot and SCORE results, Solution Options, Blueprint, Roadmap, Step-by-Step Guidance, Artefacts, Library resources, Briefings and support.
Scaling It provides self-guided, AI-assisted information and practical business systems guidance. It does not operate your external business systems or carry out changes for you. It does not provide legal, accounting, tax, medical, financial, insurance, regulated compliance, cybersecurity certification or other regulated professional advice. Professional assistance, where offered, is limited to the service scope agreed with you.
3. Eligibility and location
Scaling It is intended for Australian small businesses and sole operators. Account holders must be at least 18 years old and have authority to provide information and make decisions for the business they represent.
The app is currently offered for access and use from Australia only. Network-location controls may restrict access from overseas. This is a launch restriction and may change later. The public website may be visible outside Australia, but that does not make app services available there.
Scaling It is designed primarily for ordinary small-business systems and operational improvement. It is not suitable for high-risk, safety-critical or regulated uses described below.
4. Restricted and prohibited uses
Please do not use Scaling It to:
• support emergency, life-critical, safety-critical or other high-risk decisions;
• assess or process patient, clinical, therapeutic, disability, aged-care or other sensitive health records;
• process legal client files, privileged documents, litigation material or regulated legal matters;
• provide regulated financial, credit, superannuation or insurance advice, or process high-risk financial client records;
• process children's personal information, identity documents, tax file numbers, passwords, access tokens, API keys or other secrets;
• enter confidential or regulated information you do not have authority to disclose;
• engage in unlawful, deceptive, abusive, discriminatory, harmful or security-compromising activity;
• attempt unauthorised access, interference, scraping, reverse engineering or circumvention of the app's security or usage limits.
If you are unsure whether a proposed use is suitable, please contact us before submitting information. We may restrict or suspend use that creates a material security, legal or operational risk, subject to your applicable rights.
5. Accounts and Implementation Assistants
Please give us accurate information about your business and system, and keep it reasonably up to date. The usefulness of Scaling It's results depends on the information supplied.
Keep your login information and required second sign-in step secure. Please notify us promptly if you suspect misuse or unauthorised access.
Eligible paid accounts may invite an Implementation Assistant, subject to the plan and workspace rules. The account holder is responsible for deciding whom to invite and for removing access when it is no longer needed. An Implementation Assistant's access is limited by their authorised role and does not give them ownership of the account, subscription or Project Owner approvals.
You are responsible for maintaining appropriate rights to any information uploaded or entered on behalf of your business or others.
6. The Free Plan and paid subscriptions
Scaling It offers a Free Plan and paid subscription plans. Available features, limits, renewal terms, included support and the current price are displayed before you subscribe. Some features have assessment, generation, time or usage limits.
Paid plans are billed monthly in advance using the payment method you authorise through Stripe. Unless cancelled, the subscription renews automatically each billing month at the applicable price. We will display the renewal terms during checkout.
You may cancel a subscription through the available in-app account or billing controls. Cancellation stops future renewals, and paid access ordinarily continues until the end of the period already paid for. The account then moves to the Free Plan, subject to its feature limits. Cancellation does not delete your project records.
If a payment fails, we may notify you and retry collection. Where payment remains unsuccessful, paid access may end and the account may revert to the Free Plan, with existing project information retained in accordance with the Privacy Policy.
We will give at least 30 days' notice by email before a price change affects an existing paid subscription. Any changes remain subject to applicable consumer law.
7. Buying Solution Discovery without an account
You can purchase one standalone set of three Solution Options using Solution Discovery for A$5.00, without first creating an account.
1. Stripe authorises your card for A$5.00 at checkout but does not charge it immediately.
2. You answer the relevant business questionnaire.
3. Scaling It prepares the three Solution Options. The payment is captured only when the results are ready.
4. You can download your results as a PDF. We also email you a copy and a private access link.
If we cannot deliver the results, we will not capture the charge. If you abandon the questionnaire, the authorisation will lapse or be released without a completed purchase, subject to the payment provider's processing time.
The standalone purchase is for one set of Solution Options based on the answers provided. It does not include a full Snapshot, System SCORE, Blueprint, Roadmap, Step-by-Step Guidance or the other features of a paid subscription.
Basic Plan credit: Your purchase includes a single-use A$5.00 credit towards the Basic Plan, available for seven days after the purchase. It has no cash value, is not applicable to Premium, and is applied from your results page where eligible. The promotion is subject to the expiry and redemption conditions shown with your purchase.
Your standalone questionnaire answers and results are scheduled for deletion seven days after the purchase unless they are transferred into a Basic account within that period. Please see the Privacy Policy for information about retention and deletion.
8. Payments and invoices
All prices are in Australian dollars (AUD). Scaling It is not currently registered for GST, so GST is not charged. Stripe handles card payments, and Scaling It provides invoices or payment records as applicable. Please review the total price and any applicable discount before confirming a purchase.
Transaction records may be retained for accounting, fraud-prevention and legal purposes even after a standalone result expires or an account is deleted.
9. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law. If a service does not meet an applicable consumer guarantee, you may be entitled to a remedy, including repeat performance, cancellation, a refund or compensation, depending on the circumstances and the law.
Please contact support@scalingit.au if a service has not been delivered as described or you believe it has a problem. We will assess the circumstances and work with you on an appropriate remedy.
Subject to those statutory rights, we do not ordinarily provide refunds for a change of mind, an unused portion of a subscription period, or a delivered standalone purchase simply because you decide not to use the results. This does not limit any legal entitlement arising from a faulty or misdescribed service.
10. AI-generated content and your decisions
Some Scaling It outputs are written or assisted by AI using your information, stored system context, and relevant reference and product material. Although we work to produce useful, business-specific results, AI can make mistakes, miss information or rely on outdated details.
• Please read Scaling It's suggestions in the context of your own business before acting on them.
• Check important assumptions, costs, compatibility, permissions and results independently.
• Test changes where possible, and back up affected data before taking steps that may be difficult to reverse.
• Product features, subscriptions and prices can change. Please confirm prices and availability directly with the provider before buying.
• Obtain suitable professional advice where security, privacy, compliance, regulated activities or irreversible changes require it.
You decide which Solution Option, if any, to adopt and how implementation will proceed. Scaling It does not guarantee any particular business result, financial return, growth rate, SCORE improvement or implementation outcome.
11. Your information and ownership of content
You retain ownership of information you provide about your business, subject to any rights held by other people or organisations. You authorise Scaling It to use that information as reasonably necessary to provide the services, protect their security and meet legal requirements, as described in the Privacy Policy.
You may use and share your generated results, reports and artefacts for your own legitimate business purposes, including with your staff and professional advisers. This does not transfer ownership of Scaling It's underlying software, content system, methods, questions, templates, designs, branding or intellectual property.
Please do not copy, republish, resell, scrape or rebuild substantial parts of the Scaling It service or its proprietary materials without permission. Rights in third-party materials remain with their respective owners.
12. Third-party products, links and services
Scaling It may refer to software products, subscriptions, vendors, websites, tools, guides and external documentation. Third-party offerings have their own terms, prices, privacy practices, technical requirements and availability.
We do not control these services or guarantee that a referenced feature or integration will remain available. Please verify the current provider information before committing money, changing your system or relying on a particular configuration. Nothing in this clause removes rights you may have under Australian law in relation to services supplied by Scaling It.
13. Support and human assistance
Support is offered through support@scalingit.au, the website contact page, and any in-app support controls available under your plan. Available channels, inclusions and response arrangements may vary by plan or separately agreed service.
Where included or purchased, human assistance is provided remotely and is limited to the applicable service scope. Unless expressly agreed, Scaling It does not provide on-site visits, emergency support, hardware or network installation, or regulated professional advice. Assistance does not guarantee implementation success or establish a separate regulated professional advisory engagement.
14. Availability, changes and account suspension
We aim to make Scaling It dependable, but online services may occasionally be unavailable for maintenance, faults, security events or circumstances outside our reasonable control. We do not promise uninterrupted or error-free availability.
We may update the service, its content or features where reasonably necessary. We may restrict or suspend an account for material misuse, unauthorised activity, security risks, failure to pay or legal requirements. Where appropriate and practicable, we will explain the reason and offer a reasonable opportunity to resolve it.
You may close your account using the available controls. Information deletion and retention are explained in the Privacy Policy.
15. Responsibility and limitations
Scaling It is designed to support informed decisions, not to replace your responsibility for operating and managing your business systems. We are not responsible for decisions or modifications made independently by you or third parties, except to the extent that liability cannot lawfully be excluded.
Your rights under the Australian Consumer Law and other non-excludable laws remain unaffected. To the extent permitted by law, we exclude liability for losses arising solely from incorrect information supplied by you, unauthorised use, or independent third-party products and services. Any further limitation of liability applies only to the extent allowed by applicable law.
16. Changes to these Terms and ending the service
We may revise these Terms. The current version and update date will be shown on the website and in the app. We will notify account holders by email at least 30 days before an important change to these Terms takes effect, unless a shorter period is required to address law, security or an urgent service issue.
If we decide to stop offering Scaling It, we will aim to give at least 30 days' notice, and a practical opportunity to download available records before the service closes, except where circumstances beyond our reasonable control prevent this. Existing customer rights and legal obligations continue to apply.
17. Governing law and contact
These Terms are governed by the laws of New South Wales, Australia, subject to applicable Commonwealth law and any mandatory rights that cannot be excluded.
For account, billing, service, legal or support questions, please contact support@scalingit.au or visit https://www.scalingit.au/contact.
